More than one million HIV testing kits have been recalled following a global alert by the World Health Organisation over their accuracy.

The Public Health and Sanitation ministry has said the Standard Diagnostic Bioline, one of the three kits used for HIV testing in the country, had diagnosed patients as HIV negative when they were positive.

“Following the World Health Organisation (WHO) global alert, the Government of Kenya has instituted an immediate recall of all Bioline rapid test kits supplies from all health facilities and VCTs in the country,” said the National Aids and STI Control Programme (Nascop).

The Public Health ministry directed provincial directors and Aids and sexually transmitted diseases sector co-ordinators to remove the kits from health facilities. The Director of Public Health and Sanitation, Shanaz Sharif, said Bioline rapid test kits constituted about a tenth of the tools in circulation which he estimated at 10 million units.

WHO issued the directive following increased cases of discrepancies in results from the testing kits. The kit is manufactured by Standard Diagnostic Inc, a South Korean medical equipment maker. The recall suggests failure on the part of government laboratories which conduct quality tests on equipment and approve use. Medical practitioners use three test kits to check the presence of the HIV virus in a patient. The first test, called screening test, is performed using the Determine kit, which detects if someone is HIV positive.

Bioline is used to detect HIV negative blood samples. In cases where the two don’t give consistent results, the Unigold test is used as a tie breaker.

Following the anomaly, the government has replaced the Bioline kit with Unigold for confirmatory tests.

The Long Elisa method will be used as a tie breaker in cases of discrepancies, with Determine being used for screening. “Unigold will replace Bioline as the confirmatory HIV test kit,” said Dr Sharif.

In cases of discrepancies, HIV testing and counselling service providers will now have to send dried blood samples to the National HIV Reference Laboratory by courier service for determination of final test results.

Officials at Kenya Medical Research Institute (Kemri), however, said that Bioline was not widely used. “About seven per cent of Kenyans coming for HIV tests are positive. Given that Bioline is used to detect negative status, there are less of the Bioline kits out there,” said Dr Matilu Mwau, a paediatrician with Kemri.

KENT COUNTY, Mich. (NEWSCHANNEL 3) – Health officials in Kent County are still trying to track down any possible victims of a man who was trying to spread HIV.

David Smith told detectives he had sex with “thousands” of people without telling them he had the virus.

While investigators doubt that number is accurate, a new alleged victim did come forward yesterday.

The second victim in this case is identified only as Jane Doe. She will remain anonymous, as will any other victims who come forward.

Yesterday Smith was arraigned on a second charge of trying to spread AIDS to an uninformed partner.

Investigators believe Smith has some mental health issues, but they also say he knew exactly what he was doing by seeking multiple sex partners for the purpose of spreading the virus.

Smith’s bond has been raised to $100,000, meaning he’ll likely remain behind bars.

Police say anyone who had contact with Smith should call them immediately, then head to the health department for testing.

I’m rounding up the year in a series of posts — in which no doubt I’ve missed something, so please let me know what I’ve missed in the comments!

Decriminalization of homosexuality and anti-discrimination

In 2011, we saw an increased impact in 2011 of the work of the UN Human Rights Council, particularly its Universal Periodic Review (UPR) process of interrogating country’s human rights records, and other long term work by activists starting to bear fruit in other parts of the United Nations and other international bodies as well.

The passage of a resolution against killings of LGBT at the end of last year, reversing an attempt by the Organization of the Islamic Conference (OIC) and some African countries at halting LGBT progress in international bodies, sparked a global reaction, including demonstrations and novel contact with governments by local LGBT.

This year marked the change in approach by Rwanda in particular, which had previously backed off criminalization, with its UN ambassador drawing on the country’s experience of genocide to send a message to those claiming that LGBT is not defined or that LGBT people don’t even exist.

It marked the first sign of historic change in Cuba, which appears likely to culminate in same-sex unions and anti-discrimination laws agreed to by the Communist Party next year. The way that other Caribbean countries changed positively on the UN vote on killings also marked a development which continued in several island nations during 2011.

A change of approach by South Africa on the international LGBT rights front, due to internal civil society pressure, led to them proposing the historic July resolution affirming LGBT rights at the Human Rights Council, which then led to the publication of the first UN report on LGBT human rights in December. That July resolution also caused further ripples, including the first public affirmation of LGBT rights by a Gulf civil society group, in Bahrain.

It emerged that the organized backlash against LGBT rights in international bodies, led by the OIC, Russia and the African group, was receiving support from American Christian fundamentalist bodies such as CFAM. The same people who are losing the ‘culture war’ at home have shifted to intervening in Africa and the Caribbean and various countries repeated their arguments/lies, such as Uganda claiming at the UN Human Rights Council that lesbians and gays ‘recruit’.

However, it was also clear from investigative reporting at UN HQ that many of the no-shows, abstentions or yes votes of various countries during key UN LGBT rights votes was largely down to US diplomatic pressure. This showed how both US and European pressures on LGBT rights is already happening, and working, in a year which saw extensive simplified and often inaccurate reporting on the use of such ‘leverage’, like the supposed ‘colonialist’ tying of development aid to LGBT rights.

Four countries committed themselves to decriminalization: São Tomé and Príncipe, Nauru, The Seychelles and Northern Cyprus.

In Botswana, LGBT people launched, then put on hold, a legal push for decriminalization, and in Belize LGBT people started their legal challenge to criminalization on constitutional grounds. Jamaican law is to be challenged at the Inter-American Commission on Human Rights (IACHR) and the opposition leader called for a review of the buggery law.

In Chile, all anti-gay discrimination was banned. Colombia passed an anti-discrimination law which includes prison terms. In South Africa, government action began on so-called ‘corrective rape‘, following massive international attention. But in Brazil, passage of a hate crimes law failed due to increased evangelical Christian influence in that country. And in Malawi, the government criminalized lesbians and used LGBT rights as a wedge issue against its opponents.

The anti-criminalization effort at the Commonwealth Summit failed but it did raise the issue widely in media worldwide.

Several former African leaders came out for decriminalization. In her fantastic speech on gay rights at the UN in December, US Secretary of State Hillary Clinton pointedly mentioned one, former Botswana leader Festus Mogue. But only the Zimbabwean leader Morgan Tsvangarai offered support for LGBTs amongst current African leaders.

Homosexual Army soldier Bradley Manning’s bizarre behavior, which included calling himself “Breanna” and dressing in women’s clothes, might be expected to lead some in the media to question whether Congress should have repealed the policy banning open homosexuality in the military. Instead, however, many stories about Manning’s preliminary hearing are focusing on charges from his attorneys that his confusion about his own “gender identity” means that he is somehow the victim.

“Soldier’s gender identity issues are raised in WikiLeaks case” was the headline over a Washington Post article.

But one homosexual website is worried about these stories and headlines. “This could play out very poorly in the court of public opinion: Just as we’ve closed the door on Don’t Ask Don’t Tell and are getting Americans to see gays and lesbians can serve proudly in the Armed Forces, we have someone at the center of the biggest security leak in U.S. history claiming his gender confusion and sexuality factored into his rationale for putting national interests at risk,” it said.

President Obama had promised during the 2008 campaign to repeal the anti-homosexual policy and in office has championed the appointments of homosexual and “transgendered” people to high-level federal positions. Obama’s proposed repeal was vigorously supported by media personalities such as MSNBC’s Rachel Maddow, a lesbian activist.

In another major embarrassment to the homosexual cause, homosexual activist Dan Choi, who has also appeared on the Rachel Maddow show, is actively supporting Manning. Discharged from the Army for publicly announcing his own homosexuality, Choi calls Manning “an excellent solider” and said at a demonstration in support of him that “We see the situation where our comrade is in shackles and chains, he is on trial. But I remind all of us gathered here today because Bradley Manning stood up for the truth, he is the most free among all of us. He is not the one on trial, the United States of America is on trial today. Our reputation, and what our country stands for.”

Choi, treated as a hero by Senate Majority Leader Harry Reid, had given Reid his West Point graduation ring in July of 2000 at a meeting of liberal activists and asked the senator to keep it until the military’s homosexual exclusion policy was repealed. Reid then gave the ring back in celebration of the repeal. “Choi joined Reid on stage and gave the majority leader a hug,” one report said. “The next time I get a ring from a man,” Choi tweeted later, “I expect it to be for full, equal, American marriage.”

Reid himself posted the photo of him giving Choi his ring back.

But when it appeared that Reid wouldn’t be able to pass a repeal of the homosexual exclusion policy, Choi had ripped Reid, saying, “Harry Reid is a pussy and he’ll be bleeding once a month.” He later apologized for the comments.

Asked why the major gay rights groups are not supporting Manning, Choi told Accuracy in Media that “their strategy focuses on getting politicians to like us, and re-elect those politicians who pretend to like us every election cycle. National lobby groups do not want to upset President Obama, who has already pronounced the soldier’s guilt without trial. This hero, PFC Manning, told the truth despite the consequences, and valued integrity over rank. I hope the gay groups realize that is the core tenet of our community and movement.”

The truth, according to the government, is that Manning aided enemies of the United States. However, Manning’s attorney, David E. Coombs, has argued that the information that Manning provided to WikiLeaks, founded by Julian Assange, should not have been classified in the first place and that it didn’t hurt U.S. national security.

Assange has reportedly pledged a “significant amount” towards Manning’s legal expenses and the Bradley Manning Support Network is also helping to pay for his defense. Its advisory board includes Medea Benjamin of Code Pink, leftist filmmaker Michael Moore, and Kathleen Gilberd, Co-Chair of the Military Law Task Force of the National Lawyers Guild (NLG), a legal group once designated by the U.S. Government as a Communist Party front. Gilberd co-authored Rules of Disengagement: The Politics and Honor of Military Dissent, which argues that U.S. military personnel should disobey orders and refuse to participate in “illegal wars” such as Iraq and Afghanistan.

The Bradley Manning Support Network is asking that funds for his defense be funneled to “Courage to Resist,” a group which supports “the troops who refuse to fight” in U.S. wars. It also sells a book by the title of Army of None.

Manning had been an Army intelligence analyst in Iraq. At the time of the posting of the information, Admiral Mike Mullen, then-chairman of the U.S. Joint Chiefs of Staff, said, “Mr. Assange can say whatever he likes about the greater good he thinks he and his source are doing, but the truth is they might already have on their hands the blood of some young soldier or that of an Afghan family.”

Then-Defense Secretary Robert Gates said, “The battlefield consequences of the release of these documents are potentially severe and dangerous for our troops, our allies and Afghan partners, and may well damage our relationships and reputation in that key part of the world. Intelligence sources and methods, as well as military tactics, techniques and procedures will become known to our adversaries.”

The Obama Justice Department is reportedly investigating WikiLeaks, but no charges have been filed. Democratic Senator Dianne Feinstein, chairman of the Senate Intelligence Committee, wants Assange prosecuted under the Espionage Act of 1917.

The charges in this case, United States Army v. Bradley Manning, include knowingly giving intelligence to the enemy, through the “indirect means” of WikiLeaks. The charge can carry the death penalty, but Army prosecutors have said they are not seeking that punishment.

Philip Cave, a retired Navy judge advocate, says the charges against Manning constitute the Army equivalent of the Walker spy scandal involving father and son which became known as “The Navy’s Biggest Betrayal.” The Walkers stole classified U.S. Navy documents and provided them to the Soviet KGB.

Cave tells AIM it is a foregone conclusion that Manning will face a full-blown court-martial because the government has made a convincing case that Manning violated regulations against release of classified information. He thinks Manning’s lawyers may opt for a plea deal.

The hearing for PFC Manning began on December 16, 2011 at Fort Meade, Maryland, and is designed to outline the nature of the case to be presented by the government in a court-martial.

Although President Obama has said that Manning had “broken the law,” the lack of enforcement of the military’s homosexual exclusion policy, which was then in effect, could have opened the door to Manning’s alleged law-breaking and treason.

Indeed, despite the policy against public expressions of homosexuality in the military, it appears that the Manning case is an example of how it was not enforced by the Obama Administration. Manning had been a homosexual activist, had marched in gay rights parades, and had flaunted his homosexuality on Facebook. Manning, on his Facebook page, had listed the National Center for Transgender Equality, National Public Radio, “1,000,000 strong for Daniel Choi,” Rachel Maddow’s MSNBC television show, The Daily Show, Anderson Cooper 360, Virginia Young Democrats, Media Matters for America, and Barack Obama as being among his “likes.”

It has been speculated that Manning’s idea of downloading and releasing classified information to WikiLeaks may have been his way at getting back at the United States military over its policy regarding homosexuality. He was arrested in May of 2010.

What remains to be determined is whether he was part of a secret homosexual network working with WikiLeaks and its founder, Julian Assange, once part of a group called the “International Subversives,” and whether Manning was blackmailed into obtaining and disclosing the information.

A 1950 congressional report, “Employment of Homosexuals and Other Sex Perverts in Government,” declared, “It is an accepted fact among intelligence agencies that espionage organizations the world over consider sex perverts who are in possession of or have access to confidential material to be prime targets where pressure can be exerted.”

Assange, a native of Australia with an anti-American and anti-military bent, has a criminal record for illegal computer hacking. He is himself under investigation and facing deportation from Britain for alleged sex crimes.

With lawyers for Manning insisting that he had “gender identity” problems, it is significant that Rowan Scarborough of The Washington Times reports that “the gay rights movement’s next battleground is to persuade the Obama administration to end the armed forces’ ban on ‘transgenders,’ a group that includes transsexuals and cross-dressers.”

The paper quoted Vincent Paolo Villano, spokesman for the 6,000-member Center for Transgender Equality, as saying, “Our position is that the military should re-examine the policy, the medical regulations, so as to allow open service for transgender people.” The Times added that the Servicemembers Legal Defense Network, which pushed to end the military’s gay ban, is urging President Obama to sign an executive order prohibiting discrimination based on “gender identity.”

The National Center for Transgender Equality (NCTE), which received $50,000 from the Soros-funded Open Society Institute in 2007, has issued a statement that “Don’t Ask, Don’t Tell” was “a discriminatory law and it needed to go” but that transgender servicemembers “continue serving in silence” and that crossdressers should be able to serve openly in the U.S. Armed Forces.

Ron Paul’s campaign is touting the endorsement of Phillip G. Kayser, an Iowa pastor who believes in imposing the death penalty on homosexuals, reports Talking Points Memo.

“We welcome Rev. Kayser’s endorsement and the enlightening statements he makes on how Ron Paul’s approach to government is consistent with Christian beliefs,” said Paul’s Iowa chairman, Drew Ivers, in a recent press release on Paul’s campaign website.

“Difficulty in implementing Biblical law does not make non-Biblical penology just,” wrote Kayser in a recent pamphlet. “But as we have seen, while many homosexuals would be executed, the threat of capital punishment can be restorative.” Kayser added that homosexuals could be prosecuted only after the law was enacted.

TPM adds that Paul’s Iowa state director, Mike Heath, led the Christian Civic League of Maine. In that position, he called on his supporters in 2004 to email him with information on the sexual orientation of the state’s political leaders.

Paul has had one of the more pro-gay rights records among Republicans in Congress. He voted against the Federal Marriage Amendment and for the repeal of the “don’t ask, don’t tell” policy barring gays and lesbians from serving openly in the military. However, he still supports the Defense of Marriage Act, which bars the federal government from recognizing same-sex marriages and allows states not to recognize other states’ same-sex marriages. “Like the majority of Iowans, I believe that marriage is between one man and one woman and must be protected,” he said in February.

Eric Dondero, a former senior aide to Paul, recently explained Paul’s stance on gay rights in light of racist and homophobic newsletters written under his name in the 1980s and 90s that have resurfaced. “He is not all bigoted towards homosexuals. He supports their rights to do whatever they please in their private lives,” he wrote. “He is however, personally uncomfortable around homosexuals, no different from a lot of older folks of his era.”

Gay rights activist and author Dan Savage recently defended Paul. “And Ron may not like gay people, and may not want to hang out with us or use our toilets, but he’s content to leave us the f*** alone and recognizes that gay citizens are entitled to the same rights as all other citizens,” he said in Slate. “[Rick] Santorum, on the other hand, believes that his bigotry must be given the force of law. That’s an important difference.”

Quote received by CBS News from Ron Paul’s spokesman Jesse Benton. He was responding to claims made by Eric Dondero, a former aide to the Congressman and Republican Presidential candidate.

Dondero wrote a statement for RightWingNews.com alleging that Paul is “out of touch, with both Hispanic and Black culture”, “most certainly Anti-Israel” and “personally uncomfortable around homosexuals.”

In the piece, Dondero said that Ron Paul (who is also a doctor) met with a gay Libertarian supporter in San Francisco in the late 1980s. He claimed Paul would not use the man’s bathroom:

”Ron pulled me aside the first time we went there, and specifically instructed me to find an excuse to excuse him to a local fast food restaurant so that he could use the bathroom. He told me very clearly, that although he liked Jim, he did not wish to use his bathroom facilities.”

He also relayed a second-hand story about another “flamboyant” gay supporter who was refused a handshake by Paul:

”Ron likes Bobby personally…. But after his speech… Bobby came up to Ron with his hand extended, and according to my fellow staffer, Ron literally swatted his hand away.”

Paul is a Republican from Texas. He is believed by many to be a libertarian on many issues because he argues that most Federal services and regulations are unconstitutional. His thoughts about removing government from people’s personal lives is not necessarily supported by his record, though. According to OnTheIssues.org, Paul voted against allowing gay adoptions in Washington, D.C.; supported “Don’t Ask, Don’t Tell;” and said that the “Defense of Marriage Act” was “proper.” Paul has not, however, supported a Constitutional Amendment to define marriage, primarily because he thinks marriage is a religious function that should be separate from government. He has more recently stated that he thinks marriage should only be between a man and a woman. And, in 2010, Paul changed his stance on military service: He voted to repeal DADT, saying discharges of trained and skilled personnel was “an awful waste” and made “no financial sense.”

TalkingPointsMemo.com has been tracking a connection between Ron Paul’s Iowa Campaign and a preacher named Phillip G. Kayser. The site says Kayser wants to implement “Biblical punishments for homosexuals” including the death penalty. TPM reports today that a published acceptance of Kayser’s endorsement of candidate Paul has been removed from the RonPaul2012.com website. A cached copy from Google indicates that the statement read in part:

“We welcome Rev. Kayser’s endorsement and the enlightening statements he makes on how Ron Paul’s approach to government is consistent with Christian beliefs. We’re thankful for the thoughtfulness with which he makes his endorsement and hope his endorsement and others like it make a strong top-three showing in the caucus more likely.”

Growing acceptance of male circumcision, in Africa especially, is having a dramatic and positive effect on the fight against HIV/AIDS.

AIDS has killed 30 million people around the world since it was first reported in 1981, but according to a Johns Hopkins University affiliate, for men and adolescent boys, the one-time procedure of circumcision can mean a lifetime of reduced risk of getting HIV, the virus that can lead to AIDS.

The good news is that “in some areas, it’s becoming a social norm to be circumcised, particularly among adolescents,” said Kelly Curran, director of HIV and infectious diseases at the Hopkins affiliate Jhpiego. In sub-Saharan Africa, the region of the world most devastated by AIDS, Kenya and Tanzania are making the most progress in reducing HIV infections, she added. Jhpiego implements HIV/AIDS treatment and prevention programs funded by the U.S. President’s Emergency Plan for AIDS Relief (PEPFAR) through the U.S. Agency for International Development.

The fight to stop new HIV infections accelerated in 2007, when the Joint United Nations Programme on HIV/AIDS (UNAIDS) and the World Health Organization began to scale up voluntary medical male circumcisions to reduce transmission of the virus. According to Curran, the groups that year also endorsed three surgical methods for performing the procedure following successful trials in South Africa, Uganda and Kenya. Since then, 1 million men around the world have been circumcised. Three-fourths of the procedures were funded by PEPFAR, Secretary of State Hillary Rodham Clinton said November 8 while stressing that the U.S. goal is to see a global AIDS-free generation. Clinton has noted that about 34 million people still live with the disease.

“Virtually every other strategy we have to prevent and treat HIV/AIDS depends on people doing things that are not easy,” Curran said. She cited behavioral changes such as remembering to use a condom, reducing the number of sexual partners and learning the HIV status of partners. (Jhpiego offers circumcision to men and adolescents as part of a package of services that includes teaching the correct use of condoms, testing and treating sexually transmitted diseases, promoting safe sexual practices and offering antiretroviral therapy for people who are HIV-positive.)

Circumcision is a safe and simple procedure done by well-trained and -equipped medical providers that takes 20-30 minutes, she said. There is compelling evidence that circumcision reduces the risk of sexual transmission of HIV by 60 percent, according to UNAIDS. Circumcision also has been shown to reduce urinary tract infections.

Male circumcision benefits women because it reduces the transmission of other sexually transmitted diseases such as herpes and the virus that causes cervical cancer, according to Curran.

Curran said taking HIV prevention services close to where people live has been a successful strategy. In Tanzania, for instance, Jhpiego works with a nonprofit group that uses mobile health centers so men don’t have to walk long distances to be circumcised. Jhpiego also uses radio programs and short text messages to communicate information about HIV/AIDS prevention methods to targeted groups.

In order to help other countries reach the success levels that Kenya and Tanzania are experiencing, UNAIDS and PEPFAR announced December 5 a five-year plan to expand male circumcision services for HIV prevention in 14 countries in sub-Saharan Africa. The plan was developed by the two groups along with the World Health Organization, the Bill & Melinda Gates Foundation and the World Bank, in consultation with the national ministries of health of those countries.

If 80 percent of men in the 14 countries are circumcised, 3.4 million new infections could be averted and $16.5 billion in HIV/AIDS treatment costs could be saved, Curran said. Reaching 80 percent would entail performing 20 million circumcisions on men ages 15-49 by 2015, according to UNAIDS.

The 14 targeted countries are Botswana, Ethiopia, Kenya, Lesotho, Malawi, Mozambique, Namibia, Rwanda, South Africa, Swaziland, Tanzania, Uganda, Zambia and Zimbabwe.

Los Angeles residents may soon vote on whether condom use should be mandatory for those who work in the City of Angel’s prolific porn industry.

The AIDS Healthcare Foundation, an organization that spearheaded the proposal, collected more than 70,000 signatures, which were certified by the city clerk Tuesday. The number of signatures is far more than the 41,000 needed to have the measure considered for city voting.

Under current law, porn stars must test negative for HIV and other STDs within 30 days of filming. Many argue that even the current law should be modified because HIV often does not show up in tests until months after a person contracts the virus.

“There are thousands of STDs in this industry,” Michael Weinstein, president of the AIDS Healthcare Foundation, told Reuters. “It’s the ick factor. They don’t want to deal with this because it’s sex, and because it’s porn.”

Many in the adult entertainment industry argue that mandatory condom use would destroy the fantasy associated with pornography.

While L.A. residents would vote on the issue during the presidential primary in June, the Los Angeles Times reported that the proposal still faced legal challenges.

City Attorney Carmen Trutanich filed court documents earlier this month that said the state, not the city, had the only legal authority to impose condom use on porn sets.

But Ellen Widess, head of the California Division of Occupational Safety and Health, said the proposal is a legal possibility.

In a news release on the AIDS Healthcare Foundation website, Widess said: “We remain convinced that the City of Los Angeles is not pre-empted by Cal/OSHA from asserting its authority to protect the health of employees and others, including volunteers, who may be exposed to health hazards in L.A.’s adult film industry. We believe that cities and counties can regulate under their police power unless specifically restricted by something else, and our blood-borne pathogen standard does not provide that restriction.”

Tiano describes homosexuality as a “symptom,” and that psychotherapy can bring about the integration of “this borderline personality” and “the disappearance of the symptom.” It also described homosexuality and transgender identity among children as a “disorder” that should be treated to enable children to develop “normal sexual development.”

In conversation with Haaretz, Tiano said the chapter is a historical survey and does not represent current thinking on the issues.

Eight years ago Gidi Rubinstein, a psychotherapist who teaches at the Netanya Academic College and whose clinical practice specializes in gay and bisexual clients, published an article in the column in the gay and lesbian monthly “Hazman Havarod” criticizing the book. Tiano contacted him to discuss his concerns. Rubinstein said he expected his objections would be addressed in the 2010 edition but they were not.

Rubinstein was particularly critical of the platform he said the book gives to the views of Socarides. Tiano said the characterizations of homosexuality as a “disorder” or “symptom” in the chapter are simply descriptions of obsolete views. “I explicitly wrote in the chapter that it is not a disorder.”

“In its current edition, the chapter on homosexuality not only constitutes a declaration of homophobia, but it educates future therapists and educators to be homophobic,” Rubinstein said. The fact that the book is published by a university press, Dyonon, and that it was compiled by four leading figures in the psychiatry field gives the book added importance. Avi Chamo, the CEO of Dyonon said he was proud of the book, which is in its fifth edition and is a bestseller. He said the book was designed to survey a range of views and promote academic discourse.

“There is a word or two that needs to be proofread,” Tiano acknowledged. “In advance of the next edition of the book, I commit to carry out additional proofreading and to change the two or three words that have to be changed in the chapter.”

‘Unfortunate’

Chen Langer of the Israeli National LGBT (Lesbian, Gay, Bisexual, Transgender) Task Force, known as the Aguda, said: “It is unfortunate that a book is taught in Israeli universities that still defines, whether intentionally, unintentionally or out of negligence, any sexual orientation as a medical diagnosis in and of itself that requires ‘diagnosis’ or, God help us, any kind of ‘treatment.’ Langer said the Aguda wants the Council for Higher Education to order the book’s immediate removal from university and college reading lists and libraries.

Chamo said in a response that the book’s title, “Select Chapters in Psychiatry,” indicates its contents – a “review of myriad theories in theoretical and clinical psychiatry. In my humble opinion, professionals in the fields of education, mental health, social work and academia (as the petition’s signers claim to be) should be familiar with all the existing theories” in order to promote professional discussion and enable clients to make educated decisions about their treatment.” Chamo said Dyonon would refer any professional errors to the authors and make corrections as needed.

The Council for Higher Education said in a response that under the provisions of the laws governing academic freedom the individual academic institutions, not the council, decide on which texts they teach.

Former US president Richard Nixon had a gay affair with his best friend, a Mafia-connected Florida wheeler-dealer named Charles ‘Bebe’ Rebozo, according to a new biography by Don Fulsom.

Fulsom, a veteran Washington reporter who covered the Nixon years, also insists that the 37th U.

S. President had a serious drink problem, beat his wife and by the time he was inaugurated in 1969 had links going back two decades to the Mafia, including with New Orleans godfather Carlos Marcello, then America’s most powerful mobster.

Bebe Rebozo was a short, swarthy, good-looking Cuban-American businessman with a history of failed relationships with women and close alliances with Miami’s Mafia chiefs, the Daily Mail reported.ulsom has used recently revealed documents and eyewitness interviews including with FBI agents to shed new light on long-standing doubts among White House insiders that Nixon may have been a more than just good pal with Rebozo.

He asserts that Nixon’s relationship with Pat, his wife of 53 years, was little more than a pretence. A heavy drinker whom his own staff dubbed ‘Our Drunk’, Nixon used to call his First Lady a ‘f***ing bitch’ and hit her before, during and after his presidency.

The couple had separate bedrooms at the White House and in Key Biscayne, the exclusive resort near Miami where Nixon holidayed. Mrs Nixon did not even used to sleep in the same building, however Rebozo, was in the house next door.

Fulsom also claims that one of Nixon’s former military aides had a covert job ‘to teach the President how to kiss his wife’ so that they would look like a convincing couple.

Fulsom has quoted a former Time magazine reporter who, at a Washington dinner, bent down to pick up a fork and saw the two holding hands under the table.

It was, the reporter judged, amply intimate to suggest ‘repressed homosexuality’.

Another journalist revealed how, loosened up by drink, Nixon once put his arm around Rebozo ‘the way you’d cuddle your senior prom date. Something was fishy there’.

Rebozo even became an ‘uncle figure’ to the Nixons’ two daughters, Tricia and Julie. The dapper Cuban-American selected Nixon’s clothes and even selected the films he watched at the White House.

On Nixon’s solo visits to Key Biscayne, they swam and sunbathed, indulging in their shared passions for discussing Broadway musicals and barbecuing steaks.

When Nixon became President, Rebozo was given his own office and bedroom at the White House, and a security clearance that permitted him to go in and out without being logged by the secret service.

Using a false name, says Fulsom, Rebozo even got into Nixon’s hotel suite during a trip to Europe.

The President’s closest colleagues criticized the way Rebozo monopolised Nixon’s time.

The book, Nixon’s Darkest Secrets: The Inside Story Of America’s Most Troubled President will be out on January 31, 2012.

Michele Bachmann has criticized Ron Paul and Mitt Romney on gay marriage in a final pitch to social conservatives in early caucus state Iowa, The New York Times reported.

During a Council Bluffs appearance, Bachmann attempted to use her record opposing marriage equality and abortion to distance herself from her GOP presidential rivals.

“Mitt Romney has defended gay marriage and even signed marriage licenses for same-sex couples and Ron Paul doesn’t believe the government should protect the institution of marriage,” Bachmann said. “I have a record of defending life, marriage and the family and I’ll protect them as president of the United States.”

Bachmann, who trails her rivals in the state after winning the Iowa straw poll in August, and Rick Santorum have previously leveled the charge at Romney that he helped advance gay marriage.

Santorum said during a GOP debate earlier this month that then-Governor Romney was faced with a choice after the Massachusetts Supreme Court ruled that barring gay men and lesbians from marrying was unconstitutional.

“So Governor Romney was faced with a choice: Go along with the court or go along with the constitution and the statute. He chose the court and ordered people to issue gay marriage licenses. And went beyond that. He personally, as governor, issued gay marriage licenses.”

In rebutting the charge, Romney described Santorum’s retelling as a “novel understanding” of events.

“The Supreme Court of Massachusetts determined that under our constitution same-sex marriage was required,” Romney said. “And the idea that that somehow that was up to me to make a choice as to whether we had it or not was a little unusual.”

Dane Lewis, executive director of the Jamaica Forum for Lesbians, All-Sexuals and Gays, said Jamaica Labor Party candidates have “unfortunately descended into pulling the sexuality card” in advance of Thursday’s tight vote.

“It’s been disappointing that they’ve chosen this road yet again because it seems to historically be their stance during campaigning,” said Lewis, adding that his group is not endorsing any political party.

Politicians have routinely railed against homosexuals in Jamaica, where a colonial-era sodomy law bans sex between men and many people in the highly Christian nation perceive homosexuality as a sin.

But during a debate last week with Prime Minister Andrew Holness, opposition chief Portia Simpson Miller called for a review of the law. She argued that professional competence, not sexual orientation, will determine who is selected for a Cabinet post if her People’s National Party wins.

Since then, some top Labor candidates have made homophobic comments at political rallies, among them Cabinet minister Daryl Vaz, who said “God created Adam and Eve and not Adam and Steve,” prompting applause and anti-gay slurs from his West Portland constituents.

Labor’s candidate for West Central St. James, Energy Minister Clive Mullings, asserted that easing up on laws against homosexuality would bring God’s wrath down on Jamaica, while West Kingston candidate, Kingston Mayor Desmond McKenzie, used an epithet at a rally while an anti-gay dancehall song played.

In a Sunday editorial, the Jamaica Gleaner newspaper called the recent developments “not only sad, but dangerous.”

“Some might add cynical and vulgar.”

On Tuesday, the opposition People’s National Party stressed that Simpson Miller’s comments were being distorted by Labor partisans. They said the party is committed to a review of the anti-sodomy law, not its repeal.

It is not yet clear if either side’s recent comments will hurt their chances in Thursday’s election for the island’s 63 seats in Parliament. Recent polls have shown the two main parties in a statistical dead heat.

Despite the easygoing image propagated by the island’s tourist boards, Jamaica is by far the most hostile island toward homosexuals in the already conservative Caribbean, gays and their advocates contend.

Many Jamaicans insist hostility toward gays is blown out of proportion by gay activists. Some say Jamaica tolerates homosexuality as long as it is not openly displayed.

People magazine said on Tuesday that a cover apparently featuring Twilight actor Taylor Lautner coming out as a gay man was “100 percent fake.”

“The cover in question is 100 percent fake. This began as a ridiculous Twitter joke that went viral,” said People magazine spokeswoman Julie Farin.

The fake People cover, dated January 7, 2012, was circulated on the Internet over the holidays. It featured a picture of Lautner, 19, with text saying “Tired of rumors, the Twilight star opens up about his decision to finally come out.”

Social media sites circulated the fake cover, with celebrities like Def Jam’s co-founder Russell Simmons tweeting their congratulations to the Twilight actor before realizing the hoax.

“Disappointed that people would joke about someone coming out about their sexuality. Let Taylor Lautner be whoever he wants to be,” Simmons said in a later tweet Monday.

A representative for Lautner, who previously dated country singer Taylor Swift, did not respond to requests for comment.

The authors of the hoax were not immediately known.

Chute importante de la popularité du NPD auprès des québécois: Ce dernier sondage met en évidence une tendance nette à la baise pour l’Opposition officielle à Ottawa alors que tous les autres partis gagnent en popularité. Les observateurs parlent de désaffection des québécois, de déception et de la mauvaise représentativité de Nycole Turmel, trop peu francophone aux yeux des québécois nationalistes. Or, le NPD, qui constituait une excellente opportunité pour les québécois, semble vivre le même drame que l’ADQ au niveau provincial, qui, après être devenu l’Opposition officielle à Québec, a été relégué aux oubliettes à cause de l’arrogance de ses élus. Le NPD n’a pas tout à fait cette même arrogance. Certains élus du NPD font d’ailleurs leur marque comme d’excellents élus, l’exemple d’Hélène Laverdière est éloquent pour le Village gai de Montréal. Toutefois, certaines exceptions semblent vouloir se démarquer comme le cas du député Alexandre Boulerice dans Rosemont qui lance des signaux qui inquiètent les observateurs locaux: Par exemple, son refus de participer ou de commenter la journée mondiale du SIDA récemment alors que le plus important média gai du Québec est situé dans son comté et l’avait invité à participer à cette journée. Ses habitudes de prendre la parole de façon brusque sur des questions trop globales pour le comté démontrent que le jeune député n’est pas à l’aise avec certaines questions comme l’homosexualité (dont il ne prononcera jamais le mot depuis son élection) et qu’il utilise le populisme peut-être un peu trop, comme si les rosemontois débarquaient sur la planète et n’avaient pas l’habitude de ce genre d’attitude d’élus. Les sondages confirment aujourd’hui que le NPD a raté son entrée au Québec, 80% des interventions publiques impliquaient le jeune syndicaliste militant Alexandre Boulerice, est-ce qu’on doit y voir un lien? Nous allons aider M. Boulerice à faire mieux, nous allons le conseiller s’il est encore capable d’accepter les commentaires de vieux rosemontois comme nous mais si son attitude devait perdurer, il est à prévoir que les québécois lui réserveront le même sort que pour les ex-députés du Bloc Québécois. Certitude: Les homosexuels de Montréal sont très préoccupés par son absence lors de la journée mondiale du SIDA, ce jour-là il célébrait d’ailleurs un événement qui n’avait aucun lien avec le SIDA. Les sourcils se lèvent, la déception est exprimée, il n’est pas trop tard…

Je suis triste et perdue ce soir. Je suis là, dans cet apparte- ment que j’aime et je voudrais être à des kilomètres de chez moi. Je suis sous le choc, j’ai mal à l’estomac, mal à la vie, je tourne en rond dans ces pièces que je connais dans leurs moindres détails, et même la présence des objets familiers me laisse perplexe : j’ai l’impression de visiter une maison que je connais bien, mais qui n’est pas la mienne. Le temps s’est arrêté : où est passée l’âme de cet appartement ? Et pourtant, j’aime ce salon avec le grand canapé et ses fau- teuils en cuir, la petite table basse en verre, où traînent toujours journaux, livres et revues. Je traverse la pièce, dé- place un bibelot, redresse un tableau, gestes automatiques et bêtes, mais qui me donnent l’impression de faire quelque chose. Je n’arrive pas à rester tranquille, à me calmer. Tout est silencieux, froid, tout me semble hostile. Alors, pour me donner du courage, je fais le tour des chambres, comme le faisait Julien lorsqu’il revenait après quelques jours d’absence.
« Maman, je fais mon tour ! »
C’était la phrase rituelle après les embrassades de bienve- nue. Il passait ensuite bruyamment de pièce en pièce :
« Oh, joli ce bouquet… Et cette chaise, où l’as-tu dénichée ? Ah, ici tout est à sa place. »
Il reprenait ainsi possession de « son » territoire, de « sa » maison, en commençant par sa chambre. Je le retrouvais au salon, vautré dans un fauteuil.

Il a fallu une petite phrase pour que le monde bascule pour moi. Julien rentrait d’un week-end, heureux. Il m’a regardée, le visage in- quiet et les yeux brillants. Très vite, il m’a dit :

La Banque Scotia annonce aujourd’hui le déploiement de sa stratégie globale relative au VIH/SIDA qui vise à unifier et à renforcer ses programmes et ses initiatives dans plus de 55 pays pour lutter contre cette maladie qui met la vie en danger. Cette nouvelle stratégie fait partie du programme philanthropique communautaire international de la Ban- que Scotia, Un avenir meilleur, qui unira tous les efforts de la Banque derrière trois piliers dans la lutte contre le VIH/ SIDA.
Les trois piliers sont les suivants :
1- Combattre les préjugés et la discrimination
La Banque Scotia continuera à renforcer les meilleures pra- tiques en milieu de travail dans ses bureaux et ses succur- sales et à en mettre d’autres en place. Comptant plus de 75 000 employés dans plus de 55 pays, la Banque Scotia est bien placée pour combattre les préjugés et la discrimination relatifs au VIH/SIDA.
2- Sensibiliser et informer La Banque continuera de sensibiliser les gens au VIH/ SIDA et de les informer à ce sujet. De plus, elle cherche- ra de nouvelles initiatives qui viseront principalement les enfants et les jeunes.
3- Contribuer par des dons et le bénévolat
Grâce au programme inter- national Un avenir meilleur, la Banque continuera de pro- mouvoir et de faciliter le tra- vail des organisations loca- les, les initiatives bénévoles des employés et les contri- butions matérielles dans les pays du monde entier.
Au cours des dix dernières années, la Banque et ses employés ont remis mondia- lement plus de 95 millions de dollars à des initiatives de soins de santé, notam- ment en ce qui a trait à la recherche sur le VIH/SIDA.

La Grande-Bretagne a offi- cialisé l’ouverture aux gais du don du sang, mais seule- ment ceux qui n’auraient pas eu de relation sexuelle avec un autre homme au cours des… douze derniers mois !
En matière de prévention le gouvernement anglais esti- me donc que seule l’absti- nence peut garantir la sécu- rité sanitaire. Le message qui sous-tend cette pensée est limpide : les gais seraient moins responsables que les hétéros. Un gai en couple, fidèle et séronégatif ne peut pas donner son sang ; un hétérosexuel célibataire qui a de multiples aventures et n’a peut-être jamais fait de test de dépistage du VIH le pourra.

David Testo fait ce que peu d’athlètes, professionnels ou amateurs, ont fait avant lui : déclarer publiquement son homosexualité.
« Je suis homosexuel, je suis gai, a-t-il confié à Radio-Ca- nada Sports. Je ne l’ai pas choisi. Ça fait seulement partie de ce que je suis. Et ça n’a rien à voir avec le talent d’un joueur de soccer. Tu peux être à la fois un excellent joueur de soccer et être gai. »
Pour Testo, cette sortie publique a quelque chose de libé- rateur. C’est un combat lourd à porter qui se termine. « Je regrette vraiment de ne pas l’avoir dit publiquement plus tôt. Je me suis battu avec ça toute ma vie, toute ma car- rière. Vivre la vie d’un athlète professionnel et être gai est incroyablement difficile. C’est comme porter un secret dans ses valises sans jamais être toi-même. Ça te sape toute ton énergie, en plus de devoir performer, de devoir jouer. »
Testo ne vivait pas entièrement dans le secret. Sa famille et ses amis connaissaient son orientation sexuelle. Idem pour ses coéquipiers de l’Impact et pour la direction de l’équipe. Mais le fait que la chose ne soit pas connue du public le rendait mal à l’aise. En 2009, Testo est passé par toute une gamme d’émotions. Au championnat qu’il a gagné avec l’Im- pact s’est ajouté le titre de joueur le plus utile de l’équipe, la récompense pour une année exceptionnelle. Ce moment s’annonçait euphorique, mais il a toutefois été source de grande tristesse parce que Testo ne se sentait pas à l’aise de remercier son conjoint de l’époque.
Le joueur de la Caroline du Nord a même pensé tout aban- donner à un certain moment, à raccrocher ses crampons pour faire carrière ailleurs que dans le sport. « Je me disais que la vie que j’ai choisie et le chemin que j’ai emprunté sont incroyablement difficiles. J’ai un baccalauréat en commerce
et j’ai aussi d’autres cordes à mon arc. Ça aurait été tel- lement plus facile de choisir une voie où c’est accepté. Je me souviens avoir raconté à un de mes amis homos qui est designer que je l’avais dit à mon entraîneur. Il a ri et il ne comprenait pas que je fasse tout un plat avec ça. Il venait d’un milieu ouvert où c’est accepté. » « Tous les jours, j’étais soucieux de ce que je disais, à qui je le disais, avec qui je marchais, avec qui je parlais. Et je crois que les joueurs faisaient la même chose à mon endroit. Je le sentais. C’est invivable pour un être humain. »

A l’origine de ces déclara- tions pour le moins surpre- nantes un reportage diffusé il y a une dizaine d’années à la télévision péruvienne sur la ville de Tabalosos, qui ne compterait que des gais.
Un traumatisme pour la population, et une étiquette toujours fermement accro- chée à la réputation de cette bourgade…

La Société canadienne du sida rendait public récemment un rapport où l’on estime que l’impact économique de 3 070 nouveaux cas d’infection par le VIH, au Canada en 2009, implique un coût à vie s’élevant à 4 031 500 000 $, soit envi- ron 22 % de plus qu’estimé par le passé. Le rapport aborde les coûts des traitements et les coûts associés à la perte de productivité découlant d’heures de travail manquées, pendant la durée de la vie des personnes ayant récemment contracté l’infection (à partir de 2009).
« Nous sommes conscients que cela ne se limite pas à de simples chiffres », affirme d’entrée de jeu Monique Doolitt- le-Romas, directrice générale de la Société canadienne du sida. « Vivre avec le VIH affecte la qualité de vie de la per- sonne. Nous considérons ce rapport comme une occasion de parler des besoins des personnes vivant avec le VIH au Canada. »
La valeur en dollars de cet impact sur la qualité de vie ayant été estimée à 380 000 $ par personne, lorsqu’ajoutée aux coûts en soins de santé (250 000 $/personne) et à la perte de productivité (670 000 $/personne) nous arrivons à une somme qui donne à réfléchir. En 2009, année où il y a eu un nombre estimé de 3 070 nouvelles infections, le coût total a atteint un peu plus de 4 milliards $. Bref, le VIH/sida coûte aux Canadiens 1,3 million $ par nouveau cas de VIH diagnostiqué. Mais ce n’est pas une question d’argent – la considération principale est celle des vies qui sont affectées.
Al McNutt, président bénévole du conseil d’administration de la Société canadienne du sida (SCS), nous le rappelle : « Le VIH est complètement évitable, par la prévention; et en dépit de ces statistiques alarmantes, il y a des réussites en matière de prévention du VIH au Canada : le nombre de nouveaux cas au milieu des années 80 dépassait les 6 000 par année, et a été estimé en 2009 à 3 070. »
« Il s’agit d’une bonne nou- velle », affirme McNutt. Le défi, à présent, est de join- dre les personnes qui sont à risque de contracter le VIH. « Nous avons besoin d’inter- ventions adaptées aux diver- ses cultures, pour contrer la propagation du VIH », affirme-t-il. Voilà une raison qui explique la nécessité, aujourd’hui plus que jamais, de financer adéquatement la riposte au VIH/sida. Les nouveaux cas d’infection peuvent être évités par une hausse des investissements dans des campagnes de pré- vention.
Cette année, pour la Jour- née mondiale du sida et la Semaine nationale de sen- sibilisation au sida, la SCS a créé une campagne natio- nale sur le thème « Agissons! ». Le message, disséminé par le biais des médias sociaux, d’un concours Youtube et d’une affiche imprimée, est bien simple : nous pouvons tous et toutes faire quelque chose contre la propagation du VIH au Canada. Et l’ar- gument économique pour agir n’a jamais été si évident.

Alain Rhéaume, atteint du VIH depuis plus de 20 ans, qui avait déjà participé à un premier documentaire en 2006 présenté par GGTV au http://www.gayglobe. us/rheaume032007.html, a accepté de participer à un nouveau tournage où il sera question de ses derniers mo- ments, de la vie qu’il mène avec plus de 100 comprimés par jour et du fait que le SIDA est encore une mala- die mortelle pour beaucoup de personnes en 2011.

Dans notre édition #79, nous vous parlions des déclara- tions du Directeur général de l’organisme Rézo (Séro-Zéro) relatées dans un jugement récent à l’effet que les clients des saunas gais fréquentaient ces établissements car ils sou- haitaient volontairement et en toute connaissance de cause contracter le virus du SIDA. Cela avait mené le Juge Alain Legault, siégeant dans le district judiciaire de Montréal, chambre criminelle, à rejeter le témoignage de M. Rousseau la qualifiant de “pseudo-expertise” car ses propos étaient non-fondés et n’étaient pas appuyés par quelque recherche que ce soit. Les déclarations de M. Rousseau, se présentant comme porte-parole de Rézo (Séro-Zéro) et “spécialiste de la communauté gaie” ne choquaient pas seulement le juge; la Couronne n’en revenait pas que l’on puisse ainsi, en 2011 et surtout de la part d’une organisation oeuvrant dans le milieu homosexuel, tenir des propos aussi graves et géné- ralisés.
Gay Globe Média a tenté d’obtenir une entrevue avec M. Rousseau qui a refusé, tout en s’amusant de nos questions pourtant très sérieuses, de nous expliquer l’origine de son analyse et surtout ce qui ressemble à des préjugés d’une autre époque car il en allait de la réputation non seulement des saunas gais mais des clients de ces établissements.
Gay Globe a aussi tenté d’obtenir les commentaires de trois membres du Conseil d’administration de l’organisme que prétendait représenter M. Rousseau en Cour soit messieurs David Thompson (Président), Conrad DiLorenzo DeBorgie (Vice-président) et Serge Levasseur (Trésorier) surtout pour savoir si le CA avait autorisé par résolution de tels com- mentaires. Nous attendons toujours une retour d’appel de la part de cette organisation réfugiée dans ce qui semble être un silence préoccupant certainement expliqué par les demandes de démission formulées par certains saunas à l’endroit du Directeur-général Robert Rousseau.
VIH/sida : effica- cité prouvée d’un gel microbicide rectal

Pour la première fois, des chercheurs américains dé- montrent l’efficacité d’un gel microbicide anal pour réduire les risques d’infec- tion VIH lors d’un rapport non protégé. D’après les spé- cialistes, les risques d’être contaminé lors d’un rapport anal sont de 20 à 2 000 fois supérieurs à ceux résultant d’un rapport vaginal.
Les chercheurs ont ainsi pu constater, d’une part, que le produit ne causait pas d’ef- fets secondaires notables, et qu’il permettait, d’autre part, de réduire considéra- blement les risques d’infec- tion. Quelques jours après la pré- sentation d’Hillary Clinton, du nouveau Plan américain contre le VIH-SIDA, avec, parmi les grandes mesures retenues, la circoncision médicale des hommes volon- taires, un geste qui a fait ses preuves contre l’infection au VIH, le débat prend un tour enflammé aux Etats-Unis. De vifs débats sur la circon- cision sont désormais orga- nisés à travers les Etats- Unis sous l’impulsion de quelques groupes arguant que la procédure est une violation des droits de l’hom- me et sans bénéfice pour la santé.

Or, le Pr François Simon, de l’Hôpital Saint-Louis à Paris, rapporte avoir isolé la souche N du VIH dans le sang d’un Français de 57 ans, qui aurait été infecté au Togo.
Si cette information se confirme, cela montre que cette sou- che virale a franchi plusieurs frontières depuis le Came- roun. Le groupe N a été identifié pour la première fois en 1998 dans ce pays chez une femme qui a développé le sida. Sur les plus de 12 000 personnes infectées par le VIH vivant au Cameroun et testées, seulement 12 cas d’infection par un virus du groupe N ont été identifiés. Le dépistage de ce cas est particulièrement inquiétant, explique le chercheur, en raison des symptômes sévères présentés par le patient et de la chute précoce de son système immunitaire.
Le médecin affirme que la combinaison de cinq médi- caments antirétroviraux a montré une bonne efficacité initiale, mais que l’état du patient nécessite un suivi immunologique et virologi- que à long terme.

L’étude Caprisa sera toutefois conti- nuée avec le Truvada.

Le Village gai de Montréal souffre et ça se voit. Les com- merçants et résidants exigent de la part des autorités une prise en charge des problèmes liés à l’itinérance, à la pros- titution et à la consommation de drogue mais est-il trop tard pour intervenir? Est-ce que le Village aurait été sacri- fié pour laisser la place aux deux nouveaux pôles impor- tants d’économie gaie que son Rosemont et le Plateau Mont- Royal? Il existe dans le Village des situation qui n’existent pas ailleurs et il faudra tôt ou tard qu’on se pose les vraies questions à savoir si les politiques prennent leurs responsa- bilités et si la police a vraiment le désir de maintenir “l’or- dre” et d’appliquer la loi comme partout ailleurs à Montréal?
Côté nord, Ste-Catherine Est entre Papineau et Cartier
À part deux exceptions, la revitalisation de la façade de TVA donnant sur le Village et l’ouverture prochaine d’un restau- rant de la chaîne Milsa dans les locaux du Café Européen, deux exemples montrent l’état d’abandon et de délabrement d’un Village qui a pourtant été par le passé un exemple de modernisation et d’implication positive d’une communauté: Dans la rue Amherst à partir de Ste-Catherine, côté nord- est, pratiquement tous les commerces sont fermée, à louer ou abandonnés sans que personne n’intervienne.
Pire, un pan complet de la rue Ste-Catherine, entre Pa- pineau et Cartier est laissé à l’abandon alors que juste en face, survivent courageu- sement de très beaux com- merces comme le restaurant asiatique ou le bar Le Stud.
Difficile de savoir exacte- ment quels sont les plans de la Ville ou de l’arrondis- sement mais tôt ou tard, il faudra penser à sauver cet héritage qu’est le plus gros village gai du Canada.

Pour la première fois dans l’histoire de la lutte contre le VIH, il est démontré que l’opportunité de faire régres- ser l’épidémie mondiale de sida existe. En effet, on sait aujourd’hui que le traite- ment des personnes infec- tées réduit très fortement le risque de transmission à autrui. L’accès le plus large possible au dépistage et au traitement pour les person- nes qui en ont besoin est le moyen décisif d’enrayer la dynamique de l’épidémie.
Selon l’Organisation mon- diale de la santé, le déve- loppement massif des pro- grammes de prévention, dépistage et d’accès au trai- tement peut permettre d’évi- ter la moitié des 62 millions de nouvelles contaminations prévues entre 2005 et 2015.

Suite à nos récentes recherches portant sur des organisa- tions SIDA à Montréal, et dans le cadre de nos dossiers sur la prudence face à certaines organisations qui ne respectent pas toujours les règles et la Loi face aux fonds récoltés pour le SIDA, nous tombions récemment sur le CV d’une jeune avocate montréalaise qui, se targuant de faire des dons pour le SIDA, annonçait avoir versé tous les profits générés par une parade de mode à la Fondation SIDA-Montréal.
Dans sa page de présentation, l’avocate, qui n’est plus em- ployée par la firme qui publie le CV, mentionne en anglais: “In 2005, she helped organized a variety show of which eve- ry penny went to the Sida-Montréal Foundation.”
Vérifications faites, il appert que selon le Registraire des Entreprises du Québec, la Fondation SIDA-Montréal était non seulement radiée et non opérationnelle en 2005, elle l’était depuis 1999!
Curieux de savoir comment on pouvait faire un don en ar- gent à un organisme qui n’existe plus et surtout de la part d’une avocate, Gay Globe a demandé par courriel à l’avocate de nous fournir le montant donné et de nous indiquer si des vérifications avaient été faites au préalable sur cet organis- me. Nous recevions comme réponse que le don avait en fait été fait à une autre fondation, maintenant toutefois le nom de la Fondation SIDA-Montréal sur sa présentation même après avoir été informée de notre dossier.
De plus, impossible de vérifier les dires de la généreuse avocate auprès de la Fondation SIDA-Montréal puisque le registre ne fait plus état d’aucun administrateur. De plus, l’avocate sentant la soupe chaude, nous mettait rapidement en demeure de ne pas publier notre dossier faute de quoi elle nous poursuivrait en diffamation.
Ceci confirme la nature de nos appels à la prudence. Dans des causes comme celle du SIDA, les dons du public peuvent être détour- nés grâce à des situations confuses. Pendant qu’on se sert de cette cause pour faire mousser son CV et sa réputation, quand vient le temps d’expliquer les irrégu- larités, qui émanent pour- tant de l’avocate elle-même, voilà qu’on nous demande de nous taire. Il n’a pas été possible de vérifier avant publication si un tel don avait été fait ou pas à la Fondation SIDA-Montréal ce qui démontrerait aussi la facilité avec laquelle on peut dire n’importe quoi pour faire mousser sa réputation. Nous recommandons donc fortement à nos lecteurs de toujours être prudents avant de donner et de nous consulter en cas de doute. Nous supportons depuis des années la Fondation d’Aide Directe SIDA-Montréal, qui est tout à fait sérieuse, si ja- mais vous souhaitiez poser un geste de générosité!

Est-ce que Québécor a le droit
de commettre un crime pour
faire valoir son point de vue?

C’est la question qui est sur toutes les lèvres des jour- nalistes du Québec, suite au dossier de J.E. portant sur les fausses prescriptions traitées par de simples appels télé- phoniques. Les journalistes de Québécor, sous prétexte de prouver que l’on pouvait obtenir une prescription allant de médicaments sans danger jusqu’à des narcotiques très puis- sants pouvant intéresser des narcotrafiquants, filmaient leur enquête alors qu’ils commettaient visiblement deux cri- mes graves qui étaient par la suite diffusés. Bel exemple?
Le premier, se faire passer pour médecin afin de commettre un acte dérogatoire et le second, obtenir des médicaments d’or- donnance sous de fausses représentations, frauduleusement.
Les questions éthiques soulevées par ces actes de journalistes soumis au même code d’éthique que les autres sont très graves. Est- ce qu’un journaliste, dans le cadre de ses fonctions, pour le bénéfice d’une entreprise de presse et dans le cadre d’un reportage à diffuser, a le droit de commettre un acte criminel?
Est-ce que les journalistes constituent une exception dans le code criminel si les actes sont posés dans le ca- dre de leurs fonctions? Est- ce que l’exception des jour- nalistes prime sur celle des juges, des policiers ou des dealers de drogues? Est-ce que ces crimes étaient com- mis en toute connaissance de cause par les journalistes de TVA?
Gay Globe Média a voulu sa- voir et une demande d’avis sur la question a été sou- mise à l’Ordre des Pharma- ciens du Québec, au Collège des Médecins et au Conseil de Presse, responsable de l’application des règles éthi- ques qui ne semblent pas être claires sur la question au Québec. Juin 2011) À Montréal, le 3 janvier 2008, M. Fran- çois-Robert Lemire a pro- duit un faux reçu pour une contribution électorale alors qu’il était représentant offi- ciel du parti République du Québec. M. Lemire a ainsi commis l’infraction prévue au paragraphe 2e de l’article 559.0.1 de la Loi électorale. Après avoir plaidé coupa- ble au constat d’infraction émis contre lui, le contreve- nant s’est vu imposer par le juge une amende de 1 000 $. Étant donné que l’infrac- tion constitue en plus une manœuvre électorale frau- duleuse, M. Lemire se voit privé de ses droits élec- toraux pour cinq ans au niveau provincial, ce qui inclut notamment le droit de vote et le droit de se pré- senter candidat. En outre, il ne pourra, durant cette pé- riode, exercer la fonction de représentant officiel.

Elle serait endettée au max!

Seule une portion minime des milliers de dollars collectés chaque année par la Fondation québécoise du sida (COCQ- SIDA) revient à la lutte contre le VIH. L’immense majorité des dons sert plutôt à recruter de nouveaux donateurs, nous a appris Radio-Canada.
Selon les rapports financiers déposés ces quatre dernières années auprès de Revenu Canada, 80 % des dépenses de la Fondation sont consacrés aux campagnes de collecte des dons ainsi qu’au règlement des factures de l’organisme. Seul un cinquième de l’argent amassé est donc alloué aux activi- tés de bienfaisance.
Le groupe Charity Intelligence considère en l’occurrence que les sommes consacrées au recrutement de nouveaux dona- teurs sont beaucoup trop élevées. « Plusieurs organisations font le choix de s’adresser à des firmes de sollicitation pour trouver des donateurs et cela les avantage », explique Greg Thomson, directeur de recherche du groupe basé à Toronto, spécialisé dans la surveillance des organismes de charité. « Mais, dans le cas de la Fondation québécoise du sida, il semble que ce soit un mauvais choix », souligne-t-il.
Le directeur général de la Fondation reconnaît que cette solution est coûteuse, mais qu’elle devrait s’avérer payante d’ici deux ans. « C’est très difficile, je reconnais que ça coûte cher… Mais, à long terme, ça va rapporter », argue Ken Mon- teith, soulignant que les dons sont la seule source de finan- cement de l’institution. Le directeur songe toutefois à recou- rir à une autre firme de sollicitation pour réduire ses coûts.
La Fondation québécoise du sida présente un budget défi- citaire depuis quatre ans. Dans les prochaines années, elle devra rembourser un prêt de plusieurs centaines de milliers de dollars que lui avait accordé le lobby français du sida afin de payer la firme de recrutement.
